1. General Provisions
1.1. These electronic store rules (hereinafter referred to as the “Rules”) are a legally binding document for the Buyer and the Seller (hereinafter referred to as the “Seller”), which defines the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend, or supplement these Rules at any time. The Buyer will be informed about any changes to the Rules via the online store’s website.
2. Purchase-Sale Agreement Formation
2.1. A purchase-sale agreement between the Buyer and the Seller is considered concluded when the Buyer forms and submits an order for goods in the electronic store, having first read and agreed to these Rules.
3. Seller’s Rights
3.1. In important circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability, or security of the online store, or violates their obligations, the Seller has the right to restrict or suspend the Buyer’s access to the online store without warning.
4. Seller’s Obligations
4.1. The Seller undertakes to ensure the Buyer can use the services of the online store, in accordance with these Rules.
4.2. The Seller undertakes to deliver the purchased goods by the delivery method chosen by the Buyer, according to the conditions set out in these Rules.
4.3. If due to unforeseen circumstances the Seller cannot deliver the goods ordered via the online store, the Seller has the right to terminate the purchase-sale agreement, informing the Buyer beforehand. The Seller may offer an equivalent product. If the Buyer refuses, the Seller undertakes to refund the money within 3 business days.
4.4. If the Buyer exercises the right provided in clause 5.2 of these Rules, the Seller undertakes to return the money paid by the Buyer within 5 (five) business days from the date of receipt of the returned goods.
4.5. The Seller may withhold the refund until the goods are returned or until the Buyer provides proof that the goods have been sent back, whichever comes first.
5. Buyer’s Rights
5.1. The Buyer has the right to purchase goods in the online store according to these Rules.
5.2. The Buyer has the right to withdraw from the purchase-sale agreement concluded via the online store by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery.
5.3. The Buyer can exercise the right mentioned in 5.2 only if the goods are not damaged, have not been used, and their appearance has not substantially changed.
6. Buyer’s Obligations
6.1. The Buyer must pay for the purchased goods and accept them as per the procedure outlined in these Rules.
6.2. If the Buyer refuses to accept the goods at the time of delivery without an important reason, the Buyer must cover the cost of returning the goods, upon the Seller’s request.
6.3. Upon delivery, the Buyer must inspect the parcel and the condition of the goods together with the Seller or the delivery person.
6.4. By using the online store, the Buyer confirms agreement with these purchase-sale Rules and undertakes to comply with them.
7. Prices of Goods
7.1. The prices of goods in the online store are listed in euros (EUR) and include VAT. If applicable, delivery fees are added to the total order amount at checkout.
8. Ordering and Payment
8.1. The Buyer selects the desired goods on the online store and adds them to the shopping cart. After forming the shopping cart, the Buyer enters personal details required to fulfill the order: full name, delivery address, phone number, and any other relevant information. The Buyer confirms having read these Rules and confirms the order.
8.3. Payment can be made using Swedbank, SEB, Luminor, Citadele, or Šiaulių bankas e-banking services, as well as by Visa / MasterCard credit cards. Payments are made in euros and processed via the MakeCommerce.lt payment platform.
9. Delivery of Goods
9.1. When placing an order, the Buyer must provide an accurate delivery address.
9.2. The Buyer must personally accept the goods. If the Buyer cannot accept the goods but they are delivered to the specified address, the Buyer cannot make claims regarding delivery to the wrong person.
9.3. The Seller delivers the goods within the terms specified in the product descriptions.
9.4. All product features are indicated in the description provided next to each item. The Seller is not responsible if the product’s color, shape, or other parameters differ from the actual item due to the Buyer’s monitor settings.
9.5. If the Buyer cancels the purchase-sale agreement, all paid amounts, including delivery costs, will be refunded.
10. Final Provisions
10.1. These Rules are prepared in accordance with the laws of the Republic of Lithuania.
10.2. These Rules and any legal relations arising from them are governed and interpreted according to the laws of the Republic of Lithuania.
10.3. Any disputes arising from the execution of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes will be resolved according to the laws of the Republic of Lithuania.
10.4. The Parties are exempt from fulfilling their obligations under these Rules if it becomes impossible due to unforeseen circumstances beyond their control (force majeure).
